Terms of Service

1. These terms

These terms are an agreement between you and RentRealm, of Fargo, North Dakota (“RentRealm”, “we”, “us”). They apply when you use rentrealm.com, the free website check, the dashboard at app.rentrealm.com, or a website we host for you. By creating an account or using the service, you accept them.

If you use RentRealm for a company, you accept these terms for that company and confirm you’re allowed to. You must be at least 18. Our Privacy Policy explains how we handle personal information.

2. The service

RentRealm hosts websites for property managers and landlords, publishes their rental listings, and collects inquiries from the people who visit those websites. RentRealm is in early access: some features described on rentrealm.com are planned and not available yet, and we change, add and remove features as the product develops.

We work to keep the service running and fast, but we don’t promise it will be uninterrupted or error-free, and we don’t promise any particular search ranking, number of leads, or that search engines or AI assistants will show your listings.

3. Your account

Give accurate information when you sign up and keep it up to date. Keep your password secret and tell us at once if you think someone else has used your account. You are responsible for what happens under your account, including what people you add to your company do.

4. Your content

You keep ownership of what you put on RentRealm: listings, photos, logos, text and company details, including what we import from your property management software or listing feed (“your content”).

You let us host, copy, resize, format, display and publish your content, and send it to search engines, in order to run your website and the service. This permission ends when your content is removed, except for copies we must keep by law or that remain briefly in backups.

You confirm that you have the right to publish your content, including photos, and that your listings are accurate and lawful, show the total monthly price with required fees, and are available as described.

5. Fair Housing and the law

You are responsible for following the Fair Housing Act and the state and local laws that apply to your rentals and your advertising, including rules on fees, licensing and the way you contact people.

RentRealm checks listing text for wording that may break Fair Housing rules and may hold text back until it’s fixed. This check helps you catch problems; it isn’t legal advice and can’t guarantee your listings comply. We may also hold back or remove content that we believe breaks the law or these terms.

6. Leads and visitor information

Inquiries that visitors send through your website are yours to answer. We store and deliver them for you as described in our Privacy Policy. Use them only to respond to those people and to run your business, and follow the privacy, email and telemarketing laws that apply when you contact them. If someone asks us to see or delete what they sent you, we will tell you and may act on the request where the law requires it.

7. Acceptable use

Don’t use RentRealm to:

• publish fake, misleading or scam listings, or rentals you aren’t authorized to advertise;
• discriminate, harass, or publish unlawful or infringing content;
• send spam, or collect information about visitors for anything other than answering them;
• upload malware, probe or break our security, or overload the service, including through the website check;
• copy, resell or rebuild the service, or get around its limits.

We may remove content or suspend a website or account that breaks these rules, and tell you why when we can.

8. Domains and subdomains

If you connect your own domain, it stays yours and you keep control of its DNS records. A rentrealm.com subdomain is ours: we let you use it while your account is open, and we may change or reclaim a name that is misleading or infringes someone else’s rights.

9. The free website check

The website check reads the public pages of the site you enter, as search engines do. It is automated and may be wrong or incomplete, so treat its report as a starting point. Check only sites you have a reason to check.

10. Plans and fees

The Free plan costs nothing. Paid plans are not on sale yet; the prices on rentrealm.com are planned prices. Before we charge you anything, we will show you the price, how billing and renewal work, and how to cancel, and you will agree to them at checkout. Early Access Program terms are agreed separately in writing.

11. Other services

RentRealm works with services we don’t control, such as your property management software, listing feeds, map providers and virtual tour hosts. Their own terms apply to them, and we aren’t responsible for their availability or content.

12. Ending your use

You can stop using RentRealm at any time; email privacy@rentrealm.com to close your account. We may suspend or close an account that breaks these terms, or end the service with reasonable notice. When an account closes, its websites go offline. Ask within 30 days and we will send you a copy of your listings and leads.

13. Disclaimers

RentRealm is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

14. Limits on liability

To the extent the law allows, RentRealm is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, leads or data. Our total liability for any claim about the service is limited to the greater of the amount you paid us in the 12 months before the claim and $100.

15. Your responsibility for claims

If someone makes a claim against RentRealm because of your content, your listings, the way you use leads, or your breaking these terms or the law, you will cover the reasonable costs of that claim, including legal fees.

16. Governing law

North Dakota law governs these terms, without regard to its conflict-of-laws rules. Any dispute goes to the state or federal courts in Cass County, North Dakota, and you and we agree to their jurisdiction. Nothing in these terms takes away rights you have as a consumer under the law of the state where you live.

17. Changes to these terms

We may update these terms. We will change the date at the top of this page, and for significant changes we will tell account holders by email or in the dashboard before they take effect. If you keep using RentRealm after that, the new terms apply.

18. General

These terms and the Privacy Policy are the whole agreement between us about RentRealm, unless we sign something else in writing. If part of these terms can’t be enforced, the rest still applies. Not enforcing a term isn’t a waiver of it. You may not transfer these terms without our consent; we may transfer them if RentRealm is sold or merged.
